The Regulatory Reform (Fire Safety) Order, 2005 – effective 1 October, 2006 – replaces or amends all previous fire regulations and laws – fire certificates are now a thing of the past and will need to be replaced with an up to date fire risk assessment.  The new requirements of Section 156 of the Building Safety Act 2022 now require that all Responsible Persons must record their completed fire risk assessment, and in full (where previously only specific information was required to be recorded).

What is a fire risk assessment?

A fire risk assessment is a legal requirement under the Regulatory Reform (Fire Safety) Order 2005. A fire risk assessment is a systematic and methodical look at your  business premises, the different ctivities carried out there, and the probability that a fire could start and cause harm to anyone in and around the premises. The purpose of a fire risk assessment is:

• Identify fire hazards.

• Reduce the risk of hazards causing harm to as low as reasonably practicable.

• Understand and decide what physical fire precautions and management arrangements are required (where necessary) to ensure the safety of people in the premises if a fire does start.

  • ‘Where necessary’- When deciding what fire precautions and management arrangements are necessary you will need to take account of this definition.

• Hazard: anything that has the potential to cause harm.

• Risk: the chance of that harm occurring.

If your business or organisation employs five or more people, or your premises are licensed or an alterations notice requiring it is in force, then the significant findings of the fire risk assessment, the actions to be taken as a result of the assessment and details of anyone especially at risk must be recorded.
