The Management of Health and Safety at Work Regulations 1999 place duties on people and companies, to carry out risk assessments. This requires all employers and self-employed people to assess the risks to workers and any others who may be affected by their work or business. Risk Assessments will enable them to identify the measures they need to take to comply with health and safety law. Those who employ five or more employees should record the significant findings of that risk assessment.
SMS Europe Health and Safety Consultants have been working with their clients and carrying out risk assessments in conjunction, or on their behalf since the regulations came into force. Over time we have developed a risk assessment format and process that we believe to provide the best possible way to carry out the risk assessment process.
Our risk assessors are Health and Safety Consultants who are members of the Institution of Occupational Safety and Health, with at least five years’ experience. We have knowledge of carrying out risk assessments in a large array of businesses and sectors. Our risk assessments are not only suitable and sufficient but ensure that all aspects of the subject are appropriately assessed with reference to the correct HSE guidance, industry best practice and where appropriate, industry standards.
What does the law say on risk assessments?
The Management of Health and Safety at Work Regulations 1999 outline the requirements in Regulations 3:
Regulation 3 Risk assessment
(1) Every employer shall make a suitable and sufficient assessment of-
(a) the risks to the health and safety of his employees to which they are exposed whilst they are at work; and
(b) the risks to the health and safety of persons not in his employment arising out of or in connection with the conduct by him of his undertaking,
